Please read these Terms of Service ("Terms") carefully before using the services provided by FlowVid AI (hereinafter referred to as "FlowVid AI," "we," "our," or "us"). These Terms constitute a legally binding agreement between you ("User" or "you") and FlowVid AI.
These Terms apply to your access and use of the FlowVid AI mobile application, official website, and all related features, content, and services (collectively, the "Services").
By downloading, installing, accessing, or using the Services in any manner, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you do not agree to any part of these Terms, please immediately cease using the Services and delete the application.
In the event of any discrepancy between different language versions of these Terms, the English version shall prevail.
1. Modification of Terms and Services
We may modify, update, or adjust these Terms or the Services from time to time for business, technical, legal, or security reasons. Material changes include, but are not limited to, modifications to pricing, data usage practices, dispute resolution mechanisms, or limitation of liability.
If a change materially affects your rights or obligations, we will provide notice through in-app prompts, pop-ups, email, or other reasonable means at least 30 days before the changes take effect.
Updated Terms become effective upon publication. Your continued use of the Services after the effective date constitutes your acceptance of the modified Terms. If you do not agree to the changes, you must immediately stop using the Services and uninstall the application.
We reserve the right to modify, suspend, or discontinue any or all features of the Services at any time without prior notice, to the extent permitted by applicable law.
2. Eligibility and Age Requirement
You must be at least 13 years old (or the minimum age required by applicable law in your jurisdiction) to use the Services. If you are at least 13 but have not reached the age of majority in your jurisdiction, you must use the Services under the supervision and with the consent of a parent or legal guardian, who shall also agree to these Terms on your behalf.
You may not use the Services if:
You do not agree to these Terms;
You are not eligible to enter into a legally binding agreement; or
Applicable laws or regulations prohibit your use of the Services.
3. Account
Certain features of the Services may require you to create an account. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.
You agree to provide accurate and complete information when creating your account and to update such information as necessary. You must notify us immediately at developer@codescie.com if you suspect unauthorized use of your account.
We reserve the right to suspend or terminate accounts that are inactive for an extended period or that violate these Terms.
4. User Conduct
You agree to use the Services reasonably and lawfully. You shall not engage in the following prohibited activities:
Use the Services in violation of any applicable laws, regulations, or public order;
Upload, generate, or disseminate illegal, harmful, infringing, defamatory, obscene, pornographic, violent, hateful, discriminatory, or otherwise objectionable content;
Infringe upon the intellectual property rights, privacy rights, portrait rights, or other legal rights of any third party;
Reverse engineer, decompile, disassemble, tamper with, or interfere with the normal operation of the Services;
Bypass, damage, or attempt to circumvent security mechanisms or technical restrictions;
Use unauthorized automated scripts, bots, crawlers, or data scraping tools to access the Services;
Impersonate any person or entity, or misrepresent your affiliation with any person or entity;
Assist, encourage, or induce others to commit any of the above acts.
We reserve the right to remove content and suspend or terminate accounts that engage in prohibited activities, at our sole discretion and without prior notice.
5. Intellectual Property
FlowVid AI and its licensors retain all intellectual property rights in the Services, including but not limited to software code, interface design, icons, text, audio, video, trademarks, logos, and algorithms.
Except for the limited, non-exclusive, non-transferable, revocable right to use the Services as expressly permitted herein, no other rights are granted or transferred to you. You may not copy, modify, distribute, sell, or lease any part of the Services without our prior written consent.
6. User-Generated Content & AI-Generated Content
The Services allow you to create, generate, upload, or share content, including AI-generated images and videos ("User Content").
You retain ownership of your original User Content. By submitting or generating content through the Services, you grant FlowVid AI a non-exclusive, worldwide, royalty-free, sublicensable license to use, store, reproduce, display, and process such content solely for the purpose of operating, maintaining, and improving the Services.
We will not use your User Content to train artificial intelligence or machine learning models without your explicit opt-in consent. If we introduce an opt-in training program in the future, we will provide a clear, separate consent mechanism. You may withdraw such consent at any time via the app settings or by contacting us.
You represent and warrant that:
You own or have sufficient legal rights to all content you create or upload;
Your content does not violate any applicable laws or infringe any third-party rights;
You will not upload content that contains personal data of others without their consent.
We may remove User Content that violates these Terms or applicable laws, without prior notice.
7. AI Generation Features
The Services include AI-powered tools for generating images and videos. AI outputs are automatically generated based on your inputs and are provided for entertainment, creative, and reference purposes only.
Due to the nature of AI technology, generated content may be inaccurate, inappropriate, or inconsistent with expectations. FlowVid AI does not guarantee the accuracy, completeness, suitability, or legality of AI-generated outputs. You are solely responsible for reviewing and evaluating AI outputs before using or sharing them.
AI-generated content may be labeled or watermarked to indicate its origin. You agree not to remove, alter, or obscure any such labels, watermarks, or metadata.
When using AI features, you shall not:
Generate content that exploits or endangers minors in any way, including child sexual abuse material (CSAM);
Generate pornographic, sexually explicit, violent, terrorist, hateful, or discriminatory content;
Generate realistic depictions of real individuals without their consent;
Use AI outputs for illegal, dangerous, fraudulent, deceptive, or misleading activities;
Attempt to bypass content safety filters or misuse AI features in violation of these Terms.
We reserve the right to restrict, suspend, or terminate access to AI features if we detect misuse or violations. We may also report illegal content to the appropriate authorities.
8. Subscription and Payment
The Services may offer premium features through in-app purchases or subscriptions ("Premium Services"). Pricing, billing cycles, and available plans will be displayed within the app prior to purchase.
Billing. All payments for Premium Services are processed through Google Play and are subject to Google Play's terms and conditions.
Auto-Renewal. Subscriptions automatically renew at the end of each billing cycle unless you cancel at least 24 hours before the current period expires. You can manage and cancel your subscription through your Google Play account settings.
Free Trials. If a free trial is offered, it will convert to a paid subscription at the end of the trial period unless cancelled beforehand. Each user is eligible for one free trial only.
Refunds. Refund requests are subject to Google Play's refund policies. You may request a refund through Google Play within the applicable refund window. FlowVid AI does not directly process refunds.
Price Changes. We may change subscription pricing from time to time. Price changes will be communicated in advance and will apply to the next billing cycle after the notice period.
9. Data and Privacy
Your use of the Services is also governed by our Privacy Policy, available at https://carry-blue-violin.tilda.ws/privacypolicy. The Privacy Policy explains how we collect, use, store, and share your personal data.
By using the Services, you acknowledge and consent to the collection and processing of your data as described in the Privacy Policy. We are committed to protecting your data in accordance with applicable data protection laws, including the General Data Protection Regulation (GDPR) and the California Consumer Privacy Act (CCPA), where applicable.
10. Third-Party Services
The Services may contain links to or integrations with third-party websites, applications, or services. FlowVid AI does not control and is not responsible for the content, privacy practices, or terms of any third-party services.
Your use of third-party services is at your own risk and subject to the terms and conditions of those services. We encourage you to review the terms and privacy policies of any third-party services you access.
11. Disclaimer of Warranties
THE SERVICES ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS. TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, FLOWVID AI DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, RELIABILITY, OR NON-INFRINGEMENT.
We do not warrant that:
The Services will be uninterrupted, timely, error-free, or secure;
The results obtained from the Services will be accurate or reliable;
The Services will be free of viruses, malware, or other harmful components;
Any defects in the Services will be corrected.
12. Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, FLOWVID AI, ITS AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, USE, OR GOODWILL, ARISING FROM OR RELATED TO YOUR USE OR INABILITY TO USE THE SERVICES.
Our total aggregate liability for all claims arising out of or related to these Terms or the Services shall not exceed the greater of (a) the amount you paid to us for the Services in the 12 months preceding the claim, or (b) USD $50.
This limitation of liability applies regardless of the legal theory on which the claim is based, including negligence, breach of contract, or strict liability.
13. Indemnification
You agree to indemnify, defend, and hold harmless FlowVid AI, its affiliates, officers, directors, employees, and agents from and against any and all claims, losses, damages, liabilities, costs, and expenses (including reasonable attorney's fees) arising out of or related to:
Your use of the Services;
Your User Content;
Your violation of these Terms;
Your violation of any applicable law or third-party rights.
14. Termination
You may stop using the Services at any time by uninstalling the application and ceasing all use.
We reserve the right to suspend or terminate your access to the Services immediately and without prior notice if:
You violate these Terms;
Your conduct poses a risk to the security or integrity of the Services;
Required by applicable law or regulation; or
For any other legitimate operational reason.
Upon termination:
Your right to use the Services ceases immediately;
We may delete your account and associated data in accordance with our Privacy Policy;
Sections that by their nature should survive termination (including Sections 5, 6, 11, 12, 13, and 15) shall continue in full force and effect.
15. Governing Law and Dispute Resolution
These Terms shall be governed by and construed in accordance with the laws of the State of California, United States, without regard to its conflict of law principles.
Any dispute arising out of or relating to these Terms or the Services shall first be resolved through good-faith negotiation between the parties. If the dispute cannot be resolved within 30 days, either party may submit the dispute to binding arbitration administered under the rules of the American Arbitration Association (AAA), with the arbitration conducted in English in the State of California.
To the extent permitted by law, any claims shall be brought on an individual basis only, and not as part of any class, consolidated, or representative action.
16. Severability
If any provision of these Terms is found to be invalid, illegal, or unenforceable by a court of competent jurisdiction, the remaining provisions shall continue in full force and effect. The invalid provision shall be modified to the minimum extent necessary to make it valid and enforceable while preserving the original intent.
17. Entire Agreement
These Terms, together with the Privacy Policy and any supplemental terms or policies referenced herein, constitute the entire agreement between you and FlowVid AI regarding the Services and supersede all prior or contemporaneous agreements, understandings, or representations.
18. Assignment
FlowVid AI may assign or transfer these Terms, or any rights or obligations hereunder, without restriction and without notice to you. You may not assign or transfer your rights or obligations under these Terms without our prior written consent.
19. Waiver
The failure of FlowVid AI to enforce any right or provision of these Terms shall not constitute a waiver of such right or provision. Any waiver must be in writing and signed by an authorized representative of FlowVid AI.
